By using our Services, you confirm that you have read, understood and agreed to be bound by these Terms. 1
Acceptance of TermsThe provision of Services between Speedy Group Cloud Limited and Speedy Group Corporation Limited (collectively referred to as “Speedy Group”) and the Customer is effective upon the acceptance by Speedy Group of the Application (either by the commencement of provision of the Services to the Customer, by Speedy Group taking any action in connection with or in preparation for (whether or not to the knowledge of the Customer) the provision of the Services or by other means as determined by Speedy Group and notified to the Customer from time to time). All Customers agree to comply with General Services Terms and Conditions set out herein below and all supplementary terms posted on websitehttps://hostingspeed.net/account/tos.php. 2
Payment & Refund PolicyYou shall pay, on a pre-paid basis only, for the particular service you select according to our then published rate. All payments are to be made in HKD. If you fail to pre-pay, we will terminate your service at the end of your pre-paid period. Although you may cancel your account at any time by giving written notice, there is no refund of any prepaid amounts, including on upgrade/downgrade. All Web Hosting, Domain Registration, SSL Certificate and other prepaid fees are non-refundable. If you violate our policies or fail to timely pay and your service is terminated, applicable termination and reinstatement fees will apply. A processing fee per transaction applies for: (i) any dishonoured cheque; (ii) any reversed credit card payment; or (iii) any accepted refund request. We reserve the right to suspend your account if any payment is reversed. For accepted payment methods, please refer to Payment Methods →. Contact InformationYou shall provide us with true and correct contact information, shall correct any inaccurate information, and assist us from time to time in verifying its accuracy. You can use our online Account Maintenance form to keep your contact information current. 4
Account Security & ResponsibilityCustomers are solely responsible for account security, including safeguarding login credentials. Account holders are liable for all activity under their accounts. Unauthorised use must be reported immediately. Accounts are non-transferable. Customers are fully responsible for all content hosted under their accounts. 5
Prohibited UseProhibited activities include: server abuse; unauthorized account access (internet scamming, password robbery, security hole scanning); spamming/mail bombs/hacking/spoofing, disseminating harmful content including viruses, Trojan horses, worms, time bombs, cancelbots, or any site selling/promoting bulk e-mail services; CGI script sharing with non-hosted domains; IRC/IRC bots; unlawful content under HK law including obscene, pornographic or satanic materials, government secrets, nuclear/biological weapons information, drug dealing, fraud, harassment or stalking; online gambling; damaging, defamatory or harassing material including unlawful threats, stalking, sexual harassment; infringement of intellectual property including unauthorized copying of pictures, logos, software, articles, musical works and videos; fraudulent activities including chain letters, pyramid schemes, ponzi schemes; DDoS attacks (accounts permanently disabled without refund, targeted servers may be blackholed). Violations may result in immediate service termination without notice or refund. 6
AI Services TermsAI-generated website designs and content are produced automatically. Speedy Group makes no warranties regarding accuracy, completeness or fitness for purpose. Customers are responsible for reviewing all AI-generated content for legal compliance. Customers own the copyright to AI-generated content but must ensure no third-party rights are infringed. 7
Service Level Agreement (SLA)Speedy Group guarantees 99.9% uptime for shared hosting services. "Downtime" excludes scheduled maintenance, DDoS attacks, force majeure, or customer-caused interruptions. Credit for downtime below 99.9% in any calendar month may be claimed within 7 business days as service credit (not cash refund). Dedicated server plans have separate SLA terms. 8
Server Resources & Data TransferData transfer limits are listed in each plan's service description. If you use a high amount of server resources (CPU, Memory, Network), you may be given an option to upgrade or reduce usage to an acceptable level, or your use of our servers may be limited. i) Resource Allocation: Each user is granted a specific amount of resources based on their hosting plan, encompassing bandwidth, disk storage, CPU and memory. You are permitted to use the resources provided for hosting websites, managing emails and delivering related services in accordance with your chosen plan and this Policy. ii) Excessive Resource Usage Prohibited: You are prohibited from using an excessive amount of resources that could negatively impact server performance or disrupt service quality for other users. We retain the right to monitor resource consumption and take appropriate actions — including restricting resources, suspending your account, or terminating services, with or without prior notice, at our discretion. General Guidelines: Processes invoked by the web server, cron, shell or any other method should not: consume more than 128MB RAM; utilize in excess of 15 seconds CPU time; exceed 64 open files; exceed 5 simultaneous processes; exceed the plan's inode limit (including system files); create core dump files; execute a script/binary that forks to create a fork bomb; or send outbound mail to more than 25 recipients at any given time. Database Restrictions: 15 concurrent MySQL connections per user; 10GB disk space per database; queries not to exceed 2,000 per hour; database changes (insert/update/delete) not to exceed 500 per hour. 9
Third-Party Services DisclaimerSome services rely on third-party providers including Microsoft (Microsoft 365/Exchange Online), GeoTrust/DigiCert (SSL certificates), HKIRC (.hk domains), and ICANN-accredited registrars. Speedy Group accepts no liability for third-party service outages, policy changes, price adjustments or service terminations. 10
Domain Name ResponsibilitySpeedy Group is not responsible for the use of any Domain Name or the content of the website referenced by the Domain Name. Speedy Group has not approved or endorsed any of the content of the website referenced by the Domain Name, and no express or implied warranty, representation or statement is made or given by Speedy Group as to the accuracy, fitness for any particular purpose, non-infringement (including any infringement of trademarks or service marks, whether registered or unregistered in any jurisdiction), reliability, security, or freedom from computer virus. Speedy Group does not and will not accept any liability for any loss or damage of any kind (including without limitation any indirect, special, incidental or consequential loss or damage) howsoever arising from or in connection with any use of any Domain Name or the content of the website referenced by the Domain Name, regardless of whether such claim is brought by the Registrant or any third party. Shared hosting IP addresses are shared among multiple customers; Speedy Group does not guarantee dedicated IPs. 11
Service Interruption & Force MajeureExcept for the obligation to pay monies due and owing, Speedy Group is not liable for any delay or failure in performance due to events outside the party's reasonable control, including third-party service failures, software failures, hardware failures, distributed denial of service (DDoS) attacks, acts of God, bandwidth interruptions, general network outages, earthquake, labour disputes, shortages of supplies, riots, war, fire, epidemics, or delays of common carriers. 12
Service Cancellation & ViolationsTo cancel, contact us via Phone or Helpdesk with your Account Domain Name and Password. We reserve the right to refuse or terminate service at any time in our sole discretion, with or without notice. We may remove materials from your website at any time if we determine they violate our policies. Pre-payments for terminated accounts due to policy violations will not be refunded. You agree to pay our costs including reasonable attorney fees for any third-party claim investigation. Files and data stored on our servers will be deleted after service termination. Abusive communication with our staff will result in a warning; if continued, that communication will be terminated. 13
IndemnificationYou agree and promise to defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, our agents, our clients, our officers and our employees, that may arise, result, or be threatened as a result of your actions, property or services sold or licensed by you, or the actions of your employees, agents or assigns, including but not limited to: (1) any injury to person or property caused by any products sold or distributed in association with our services; (2) any material supplied by you infringing or allegedly infringing on the proprietary rights of a third party; (3) your copyright infringement; (4) any defective products sold by you that are connected to our servers or services; (5) investigation of any alleged violations of our policies. 14
Data Loss DisclaimerSpeedy Group accepts no liability whatsoever for data loss of any kind. Although we provide backup services to generate daily/weekly backups, we cannot guarantee the accuracy of backup files. Users are responsible for backing up their own data. Speedy Group reserves the right to delete any backups associated with an account. Speedy Group shall not be responsible for damage, corruption, data loss, or removal — including cases of account cancellation and/or server malfunctions. No remedy will be provided in any case of data loss. It is your responsibility to maintain appropriate alternate backups of your information and data. We strongly recommend all customers maintain independent backups and regularly verify their recoverability. 15
Disclaimer of LiabilityWE ARE NOT RESPONSIBLE OR LIABLE FOR ANY DAMAGES TO YOU OR YOUR BUSINESS AS A RESULT OF OUR ACTION OR FAILURE TO ACT. WE MAKE NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO THE SERVICES WE PROVIDE, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS INCLUDES LOSS OF DATA RESULTING FROM DELAYS, NON-DELIVERIES, WRONG DELIVERY, AND ANY SERVICE INTERRUPTIONS WHETHER OR NOT CAUSED BY US. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFIT OR GOODWILL. YOU AGREE THAT OUR TOTAL LIABILITY FOR DAMAGES SHALL BE LIMITED TO THE TOTAL FEES PAID BY YOU TO US FOR THE ONE (1) YEAR PERIOD PRIOR TO THE ACT OR OMISSION GIVING RISE TO SUCH DAMAGES. 16
Amendments to TermsSpeedy Group may update, amend, modify or supplement the terms and conditions of this Agreement from time to time without notice. The latest terms and conditions can be obtained at https://hostingspeed.net/account/tos.php. Continued use of our services constitutes acceptance of the revised terms. 17
Governing Law & JurisdictionThe Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. The parties submit any difference or disputes arising in connection with the Agreement to the non-exclusive jurisdiction of the courts of Hong Kong. |
